PlateNet Terms of Service

These Terms apply when you create or use an authenticated PlateNet account. By checking the acceptance box and creating an account, you agree to these Terms. "PlateNet" is the name of the service. "PlateNet," "we," "us," and "our" refer to the person or entity providing the service under that name. "You" means the account holder. "Community" means a separately managed group using PlateNet.
PlateNet is a private beta for fictional gaming, simulation, and roleplay.
IMPORTANT DISPUTE NOTICE
THE DISPUTES SECTION REQUIRES INDIVIDUAL ARBITRATION AND INCLUDES CLASS-ACTION AND JURY-TRIAL WAIVERS.
Account and Beta Access
You must be at least 18 years old, be physically located in the United States while using PlateNet, provide accurate account information, agree to these Terms, and acknowledge that you have read the Privacy Policy. PlateNet may record those actions, your age confirmation, the document versions, and the date and time, and may retain those records after account deletion.
You are responsible for activity through your account and for protecting your password, devices, sessions, access codes, and credentials. You may not share, sell, transfer, or use another person's account, or bypass any age, location, permission, access, suspension, or security restriction.
Beta access is discretionary. PlateNet may change, reset, limit, suspend, or end any account, Community, integration, feature, or part of the service at any time, with or without notice or explanation. An invitation, account, Community membership, or prior access creates no right to continued access.
PlateNet is currently provided without charge. PlateNet will not charge you unless separate pricing and payment terms are presented to and accepted by you. PlateNet may instead limit or end free access.
Fictional Use and User Content
PlateNet may be used only for fictional gaming, simulation, and roleplay. It is not a government, emergency, public-safety, law-enforcement, fire, medical, court, dispatch, criminal-justice, or official-records service, and it is not a replacement for 911 or any real authority.
Do not use PlateNet for a real emergency, official operation, investigation, surveillance, medical or criminal-justice activity, decision affecting a real person, or interference with a real emergency, radio, government, or public-safety system. Do not present PlateNet content or output as real or official.
Except for account or contact information PlateNet specifically asks you to provide, you may submit only fictional, non-identifying information. Do not submit any real, confidential, sensitive, or personally identifiable information, or anything that identifies or could reasonably be linked to a real person, account, vehicle, property, incident, organization, or location. This includes, without limitation, real names, images, voices, addresses, telephone numbers, email addresses, usernames, license plates, driver's-license information, government identifiers, Social Security numbers, financial information, medical information, criminal-history information, precise location information, biometric information, and private communications.
Information you enter, upload, create, configure, or transmit through PlateNet is "User Content." You are responsible for your User Content and must have the rights and permissions needed to submit it. PlateNet may review, restrict, preserve, remove, or disclose User Content as reasonably needed to operate or protect the service, enforce these Terms, respond to a complaint, comply with law, or establish or defend legal rights. PlateNet is not required to monitor User Content.
You retain any rights you already hold in User Content. You grant PlateNet a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to host, copy, process, format, modify, transmit, display, back up, and otherwise use User Content as reasonably needed to operate, secure, maintain, improve, enforce, transfer, reorganize, or end PlateNet and its Communities and integrations. This license continues while the content remains in PlateNet, Community records, connected systems, logs, backups, or other retained records.
Communities and Connected Systems
Community tools are limited to Community membership, roles, permissions, settings, connected-system configuration, and fictional Community records and content made available through those tools. Community Owners and administrators may manage those items and view the fictional records and content available to their roles. Other Community members may view fictional records and content allowed by their assigned permissions. Community tools do not provide access to account passwords, legal-acceptance records, Contact Page communications, or PlateNet's internal administrative or technical records. Community Owners and administrators are responsible for the users, content, permissions, settings, integrations, and decisions under their control. PlateNet does not decide or resolve internal Community membership, staffing, moderation, disciplinary, or access disputes.
A Community may connect PlateNet to a separately operated system. That system is controlled by its operator and may handle information under its own terms and practices. PlateNet does not control or assume responsibility for a separately operated system and may limit, suspend, replace, or end a connection at any time.
Computer-Generated Audio
PlateNet may convert user-submitted text into computer-generated simulation audio. Generated audio may contain errors, delays, omissions, repetitions, incorrect pronunciation, distortion, or other unexpected output. A notice may identify the audio as computer generated; you may not remove, hide, alter, bypass, or misrepresent that notice.
You are responsible for the submitted text, selected destination and settings, resulting audio, and its use. You may not use computer-generated audio to violate law; exploit or harm a minor; impersonate, deceive, defraud, threaten, harass, defame, discriminate against, exploit, or harm anyone; generate or spread harmful false or personal information; conceal that output is computer generated; make automated decisions affecting legal rights; provide medical advice or interpret medical results; support real-world law-enforcement, court, immigration, or asylum decisions; or create a false emergency or official communication.
Prohibited Conduct
You may not use PlateNet unlawfully or in a way that infringes or misuses intellectual property, privacy, publicity, confidentiality, or other legal rights. You may not access any account, Community, record, system, or integration without permission; bypass authentication, permissions, limits, suspensions, bans, or security controls; attack, scan, overload, damage, disrupt, or interfere with PlateNet or a connected system; or introduce malware or harmful code.
You may not scrape or automate access without permission; resell or provide paid access to PlateNet; copy PlateNet or use it to create a competing service; reverse engineer, decompile, or attempt to derive source code from PlateNet; remove copyright, license, attribution, or computer-generated notices; use PlateNet or its software, interfaces, materials, data, content, or output to develop, train, fine-tune, test, benchmark, validate, or improve any machine-learning or artificial-intelligence model or system; or help anyone do any of these things.
PlateNet may determine whether conduct violates these Terms and may act without first providing a warning, investigation report, hearing, appeal, or explanation.
Ending Access and Deletion
PlateNet may suspend or end an account, Community, permission, integration, or part of the service at any time. You may delete your account through available account settings or request deletion through the PlateNet Contact Page.
Ending access or deleting an account may immediately remove access to information, settings, Communities, and integrations. PlateNet is not required to restore an account or recover, return, export, transfer, or preserve information. Deletion may not remove information that remains in Community records or connected systems, involves other users, is reasonably needed for operation, security, enforcement, disputes, legal compliance, or legal rights, or remains in backups or temporary copies.
PlateNet Materials, Feedback, and Copyright
PlateNet's original code, website, name, logos, graphics, layouts, interfaces, documentation, and other original materials belong to PlateNet. Third-party materials remain subject to their own licenses. Your account gives you a limited, revocable, nontransferable right to use PlateNet during the beta; it does not give you ownership or permission to copy, sell, distribute, publish, or create another service from PlateNet materials.
If you submit feedback or suggestions, you grant PlateNet a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable right to use them for any purpose without restriction, attribution, further permission, or compensation.
Copyright concerns may be submitted through the PlateNet Contact Page. The notice should identify the copyrighted work, the material involved, where it appears, and how the sender can be contacted.
Service Provided As Is
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLATENET IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT EXPRESS OR IMPLIED WARRANTIES. PLATENET DOES NOT WARRANT AVAILABILITY, ACCURACY, COMPLETENESS, SECURITY, COMPATIBILITY, ERROR-FREE OPERATION, DATA PRESERVATION OR RECOVERY, SUPPORT, OR FITNESS FOR A PARTICULAR PURPOSE. PLATENET IS NOT A BACKUP, ARCHIVAL, EVIDENCE-PRESERVATION, RECORDS-PRESERVATION, OR DATA-RECOVERY SERVICE. YOU USE PLATENET, ITS OUTPUT, AND ITS INTEGRATIONS AT YOUR OWN RISK AND SHOULD KEEP YOUR OWN COPIES OF INFORMATION AND CONFIGURATIONS YOU CANNOT AFFORD TO LOSE.
Limitation of Liability and Indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLATENET AND THE PEOPLE INVOLVED IN OPERATING OR SUPPORTING IT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, ACCESS, CONFIGURATIONS, PROFITS, OPPORTUNITIES, OR REPUTATION, ARISING OUT OF OR RELATING TO PLATENET, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PLATENET AND THE PEOPLE INVOLVED IN OPERATING OR SUPPORTING IT FOR ALL CLAIMS ARISING OUT OF OR RELATING TO PLATENET OR THESE TERMS, REGARDLESS OF THE FORM OR THEORY OF THE CLAIM, WILL NOT EXCEED THE GREATER OF TWENTY UNITED STATES DOLLARS (US $20) OR THE AMOUNT YOU PAID DIRECTLY TO PLATENET DURING THE TWELVE MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED.
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless PlateNet and the people involved in operating or supporting it from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising from your User Content, account activity, Community or connected system under your control, misuse of PlateNet, or violation of these Terms. PlateNet may assume exclusive control of the defense and settlement of a covered claim. You may not settle a covered claim without PlateNet's prior written consent if the settlement admits fault by, imposes liability on, or requires any payment or action by PlateNet.
Disputes
Before starting arbitration or a lawsuit, the complaining party must send written notice through the PlateNet Contact Page identifying the person and account involved, explaining the dispute, and stating the requested result. The parties will have 30 days after receipt to try to resolve the dispute informally.
Except for eligible small-claims cases, requests for temporary or preliminary court relief, and claims that cannot legally be arbitrated, any dispute arising out of or relating to PlateNet or these Terms must be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs. Arbitration will be conducted by one arbitrator and normally will occur remotely. If the American Arbitration Association cannot administer the matter, the parties will try to agree on a comparable administrator; if they cannot agree, a court may appoint one.
Claims must be brought only on an individual basis. To the maximum extent permitted by law, neither party may bring or participate in a class, collective, mass, consolidated, or representative action. For any claim allowed to proceed in court, both parties waive a jury trial to the maximum extent permitted by law.
You may opt out of arbitration by sending written notice through the PlateNet Contact Page within 30 days after first accepting these Terms. The notice must identify your PlateNet account and clearly state that you are opting out of arbitration.
Massachusetts law governs these Terms, except where federal law or another controlling law applies. Any court proceeding permitted under these Terms must be filed in Massachusetts unless applicable law requires another location.
Updates and General Terms
PlateNet may update these Terms or the Privacy Policy. When renewed confirmation is required, you must agree to the updated Terms and acknowledge that you have read the updated Privacy Policy before continuing to use an authenticated account. PlateNet may record those actions, the document versions, and the date and time. If you do not agree, do not continue to use your account; sign out and request deletion through the PlateNet Contact Page.
These Terms and any paid-service terms you separately accept are the entire agreement concerning PlateNet. The Privacy Policy describes PlateNet's information practices and is not part of these Terms. Using PlateNet does not create an employment, partnership, agency, fiduciary, or representative relationship.
You may not assign or transfer your account or these Terms. PlateNet may assign these Terms in connection with a change in ownership or operation. A failure to enforce a provision is not a waiver. Each provision applies to the fullest extent permitted by law. If any provision cannot be enforced as written, it will be limited or severed only to the minimum extent necessary, and the rest will remain in effect.

WhackerLink v4
PlateNet is designed to communicate with separately operated, unmodified WhackerLink v4 systems through interfaces and configuration data. PlateNet does not incorporate or modify WhackerLink v4 code.
